Shipping Cut-Off

Our webstore shipping cut-off time is 12PM Pacific Time / California time. We will do our best to ship the items the same day, if your order is received after this time, however, we cannot make any guarantees.

Returns
A 25% restocking fee is assessed for all returns. This covers the payment processing costs (e.g. Visa/Mastercard/Paypal) we incur during your purchase and refund. All shipping fees are non-refundable.

Inspection and Acceptance

a.) Customer shall have the right to inspect the goods at the time and place of delivery before accepting them.

b). The Products shall be deemed accepted by Customer unless notice of defects is received within thirty (30) days of shipping thereof and the Product is returned to Commonlands within sixty (60) days of shipping.

c.) In the event that Customer claims that goods do not conform to contract specifications, and Commonlands, after inspecting the goods, determines that the goods do not conform to the contract, Commonlands will either replace the nonconforming goods or accept a return of said goods and credit Customer’s account. Commonlands’ exclusive obligations with respect to a non-conforming Product shall be, at Commonlands' option, to repair and replace the Product, if it is determined to be defective, or to refund Customer the purchase price paid for the Product.

NOTWITHSTANDING ANYTHING HEREIN TO THE CONTRARY, THE FOREGOING IS Customer’s SOLE AND EXCLUSIVE REMEDY FOR BREACH OF WARRANTY BY COMMONLANDS WITH RESPECT TO THE PRODUCT. Refunds are issued by check for pre-paid merchandise. Credit order refunds are issued to the credit card or Account to which the merchandise was charged. 

Returns cannot be accepted if any processing has been done with/to the Product. Products assembled into housings will not be accepted for return. Products assembled and disassembled from housings will not be accepted for return. Products damaged during handling, inspection, or processing by Customer will not be accepted for return.

All shipping fees are non-refundable. The products must be unused and in the same condition that you received it. Any items which have been assembled are ineligible for our return policy. It must also be in the original packaging.
To complete a return, please let us know the reason why you would like to return the item(s) and we will provide a Return Material Authorization (RMA) with shipping instructions. A rejection notice report or DMR must be sent to Commonlands at the time of the RMA request. An RMA number must be provided prior to return of the item(s).

Customer requires authorization from Commonlands prior to issuing any debit notes.

Our policy lasts 30 days. If 30 days have gone by since your purchase, unfortunately, we can’t offer you a refund or exchange.


Cancellations

For online orders, if you just placed the order please email contact@commonlands.com  ASAP and we will try to cancel before shipping. Orders placed through our website using an online payment method, and which have shipped, can be refunded for a 25% restocking fee or with a 10% fee for store credit. Please submit your request to contact@commonlands.com. 

Orders placed using Purchase Orders are non-cancellable non-refundable, unless otherwise agreed upon in writing on a mutually accepted document. Orders, submitted via Purchase Order, for which work has started are subject to a cancellation fee up to, and including, the entire order value.


Refunds

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.


Late or missing refunds

If you haven’t received a refund yet, first check your bank account again. Then contact your credit card company, it may take some time before your refund is officially posted. Next contact your bank. There is often some processing time before a refund is posted.

Shipping

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you, may vary. If you are shipping an item over $100, you should consider using a trackable shipping service or purchasing shipping insurance. We do not recommend USPS for orders exceeding $250.


Lead-time

The quoted lead-times and shipping times are best estimates only. Unfortunately, we have no control over their shipment times after we give a carrier the package. So, please understand that any date of delivery is only an estimate and we have no liability for late or partial deliveries as a result of your selected shipping method.

Warranty          

Commonlands warrants that all Products will conform to and perform in accordance with the applicable current specifications issued by Commonlands. This warranty shall not apply to any Product that shall have been subject to misuse, abuse, accident, disaster, improper cleaning or which has been used contrary to current instructions. This warranty also does not cover products exposed to >60C operating temperature, reliability testing, or harsh conditions.

                                                           

Other than as expressly set forth above or as contained in any express warranties provided with products and the extent permitted by law, Commonlands makes no warranties, express or implied, including warranties of merchantability or fitness of the merchandise for any particular purpose. Commonlands shall not be liable for loss or damage arising directly from the use of any item it sells or for any incidental or consequential damages.             


Limitation of Liability

The liability of Commonlands hereunder for all claims shall not exceed the sum of Customer’s payments for the Products which are subject of the dispute.

Indemnification 

Purchaser will indemnify and hold harmless Commonlands from reasonable liability, claim, loss, damage, cost or expense arising from injury or damage to property or person, caused in any manner by the possession, use or operation of the product.        

Statute of Limitations
No action by Customer may be brought at any time more than twelve (12) months after the facts occurred upon which the cause of action arose.

Force Majeure

In no event shall the Commonlands be responsible or liable for any failure or delay in the performance of its obligations hereunder arising out of or caused by, directly or indirectly, forces beyond its control, including, without limitation, pandemics, strikes, accidents, acts of war or terrorism, civil or military disturbances, nuclear or natural catastrophes or acts of God, and interruptions, loss or malfunctions of utilities, communications or computer (software and hardware) services; it being understood that the Commonlands shall use reasonable efforts which are consistent with accepted practices in the banking industry to resume performance as soon as practicable under the circumstances.
